Snowkiter Terms & Conditions of Booking

1. Introduction
Snowkiter have tried to keep the terms of booking to a minimum, as we are confident that our clients will honour their contract with us. In return we shall endeavour to ensure that all of our obligations are fulfilled to the best of our ability. However, your attention is drawn to the following booking conditions before signing your booking/ registration form. Other published conditions relevant to any of the services supplied by other companies and booked by us on your behalf are available upon request.

2. Contract

All booking applications should be accompanied by a completed Booking Form. If you are making your booking more than eight weeks prior to the departure date a deposit (minimum 10% or £100, which ever is greater) is due. Bookings taken within eight weeks of departure require the full amount to be paid.

3. Cancellation
BY YOU - Should you wish to cancel or amend your reservation, once it has been accepted by us, we must have written instructions to that effect. Cancellation / amendment charges will become applicable, as below. Balances are due 10 weeks prior to departure. If this balance is not received within 7 days of the due date cancellation may be assumed by the company with consequent loss of deposits and /or cancellation charges.

Note that all cancellations will be considered on an individual basis, and we will endeavor to return you money wherever possible. However our first priority must be to safeguard our business by covering all costs incurred to ourselves.

Cancellation charges:
More than 8 weeks: Loss of deposit (See note 1).
8 - 4 weeks: 40% of total cost.
Within 4 weeks: Non refundable.

Please note:
1. Regardless of holiday value and notice, the minimum cancellation fee will be 20% or £100.00 per person which ever is the greater.

BY US - Snowkiter reserves the right to cancel your holiday. In the unlikely event that we have to cancel your holiday we will offer you alternatives of a similar holiday as per our current program without any extra charge to you. If the alternatives we offer are not acceptable or unavailable to you please notify us in writing by return of post. We will then refund the monies paid by you for the complete cost of your holiday. Such a payment is to constitute full and final settlement of all claims (if any) that you may have against us in respect of cancellation.

Force Majeure
a) These payments will not be made for changes that arise as a result of situations outside of our control. For example, technical or maintenance problems with transport, changes imposed by rescheduling or cancellation of flights by an airline or main charterer, the alteration of the airline or aircraft, or refusal of landing rights by the CAA to any airline.

b) This also includes any other acts of force majeure (namely: war or threat of war, riots, terrorist activity, civil strife, strikes and other industrial disruption, natural disasters, fire, quarantine, epidemics, weather conditions, Government action, or other events beyond our control).

c) If we have to curtail your holiday after departure due to a situation of force majeure, we will offer a pro-rata refund for unused accommodation and excursions only. Compensation will not be payable.

d) The weather can be a fickle Mistress. Snowkiter cannot guarantee that conditions will always be favorable for snowkiting, either in terms of the wind or glacier surface conditions. We do not offer no wind refunds of any description whatsoever, neither can we be expected to provide alternative activities at cost to ourselves.

4. Amendments
We strongly advise you to book all of your holiday requirements at the time of booking. A minimum charge of £10 per new invoice issued will be levied after receipt of your confirmation invoice in lieu of administration costs. All amendments must be notified in writing.

5. Limitation of Liability/ Disclaimer
Snowkiter shall not be liable for any loss or damage arising from any matter outside the reasonable control of Snowkiter including (but not limited to) Acts of God, War, Civil disturbances, force majeure, strikes or other industrial action, acts of government, acts of third parties, activities on adjoining land including building works or failure of public supplies including (but not limited to) electricity and water. Where acts of third parties are involved we shall in no circumstances be required to institute any form of legal process.

8. Insurance
It is always recommended to take adequate holiday insurance. We also require that everyone attending take out BKSA insurance or equivalent cover.

9. Vaccinations & Health
You must ensure that you have complied with any health requirements, such as vaccinations, for any country you may be visiting. The governmental Health Advice for Travelers booklet is available upon request and you should consult your GP if you have a medical condition of any kind.

10. Passports & Visas
All British nationals must hold a full 10-year passport, with at least 6 months validity remaining, for entry into most countries. Visas are the sole responsibility of each person traveling but advice and assistance will be provided when requested.

Snowkiter and any Employees of Snowkiter cannot take responsibility for your Passport/ Visa requirement.

11. Breakdowns / Complaints
If you are dissatisfied, you must write to us giving full details of your complaint within 30 days of your return to the UK. It is unreasonable to take no action whilst on holiday but then to write a letter of complaint upon your return. We regret we cannot accept liability in relation to any complaint which is not brought to our attention entirely in accordance with this clause.

12. Your Responsibility
1. You must have comprehensive kiting insurance when traveling.
2. We can refuse to accept you as a customer or continue dealing with you if your behaviour is disruptive and affects other holidaymakers, employees or any third party. If we do this, we will not be responsible for any additional costs which you have to pay. If you are prevented from traveling because in the opinion of any person in authority you appear to be disruptive, we will have no further liability to complete your holiday arrangements, and will not be liable for any refund or compensation.
